Public comments v natural justice

    No, I read it at the time and I just read it again to make sure. Looking at it objectively, there's no anti-woman sentiment from PB that I can make out. Arguing yes but anti-woman no.

    I think it would be fair to say he kicked an own goal with his last post in this thread though bolding his own quote instead of yours. He should probably give himself an uppercut for that one.

    Thanks very much PB but it's not necessary, I have no problem with what was posted. It made me think a bit which I suspect was the point.

    I didn't find my earlier posts (will look again when I have more time) but if memory serves me correctly I didn't think it was illegal (which I was corrected) but I certainly don't personally believe it's ok to take advantage of that situation.

    Discovery will be interesting and old mate will have to take the stand in his defamation trial , Does anyone remember how Ben Roberts Smith defamation trial went ? this could get interesting if he goes through with it but he might squib it at the discovery stage like Alan Jones did in his case against SBS

    So now the soap opera moves on....Lisa Wilkinson’s defence in her defamation case states she is “not a lawyer” and “understood” Ten’s colleagues had fact-checked Brittany Higgins’ allegations.  Ms Wilkinson’s team claimed she was not familiar with defamation law and “would have complied with any and all” advice or request from lawyers to alter her reporting.

    It is noteworthy that she has taken the “an employee for the purposes of the Employers’ Liability Act”, defence, a NSW law that sets out the circumstances in which an employer is liable for their employees’ conduct, including for torts such as defamation stance.
    That law says an employer is “liable to indemnify the employee in respect of liability incurred by the employee” in certain circumstances, and the usual position would be that Ten would be liable for Wilkinson’s costs and any damages payout.
    Its a case of i didnt know the law, and if i am found liable someone else can pay my bill....but i am not going to hand back my award!
