RWC bulls—— in vic

    So I’m looking at a 70s shovel, spoke to a couple of rwc guys here ‘nope won’t pass it, needs ADR stamped exhaust’, I’ve pointed out that pre 89 didn’t have ADR stamps ‘don’t care, vic roads need to see stamps’.

    Now this wasn’t just a one off roady guy, a lot of them seem to be saying it, how the hell are you meant to put something on there that does not exist?

    Add to that the chassis number is not found in their records, spoke to vicroads ‘yeah our records pre 90s are pretty sparse, they haven’t been digitised, so you’ll have to get it through a VASS engineer’.

    Am I missing something here? Anyone in Vic know what the hell is going on?

    The ADR for the year of the bike model is the ADR that is supposed to apply. From what I can recall, noise levels weren’t in the ADRs in the 1970s for motorcycles so you shouldn’t have a problem. Ask them why they’re using today’s ADRs for a 1970s motorcycle? And ask in writing so you get a written response so there is some accountability and you won’t just be fobbed off. 

    The only issue I could foresee is if the motorcycle was brought in as a grey import many years later at which time the ADRs of that time might apply. But either you or vicroads or somebody should have history on its original registration and compliance with ADRs. If you or vicroads don’t have that, I’d be asking in writing why the ADRs from 197x are not being applied given VicRoads has no basis for saying any of the newer ADRs ought to apply

    Well that’s part of the issue, the bike was either unregistered or on club plates for who knows how many years which is part of the issue, since the vicroads records are so piss poor (even the guy at vicroads said it was probably more down to they didn’t keep great records) so it doesn’t show up, I’ve tried other states but they require VIN for online searches (mid 70s was chassis not vin).

    Eg, the RWC guys, and Vic roads.  You cant have it if it dont apply for that year model.  If all else fails,  before spending $$ on an engineer

    When I was selling my evo Springer, it turns out it had never been on full rego anywhere in Australia and had only ever been on club rego. A guy interested in buying it from Victoria raised that as an issue that he’d need to get it engineered so he wanted me to discount it $1,000. Bike had engineering certificate from when it was imported and complied so I wasn’t prepared to discount the bike on that basis. The difference is with the shovel you’re looking at it sounds like the owner doesn’t have that important history and perhaps onus is now on you or him to prove when it was imported and what compliance process has already applied and if not what compliance process ought to apply. 

    Maybe just put adr compliant exhaust and mufflers on the bike from a newer bike (may be a bit of fucking around for fitment) and get it passed. I seem to recall Victoria was more anal on issues with bikes that have never been on full rego as opposed to nsw if the shovel has in fact been on club plates. It’s an issue for the seller to resolve or discount accordingly. 

    I’d still be asking vicroads to provide their decision and advice in writing, citing the legislation, regulations and rules for substantiating their response

    Are you wanting full rego or club rego? 
    Being a shovel the club rego has to be appealing and should be an easier process

    Either or really.. but club reg in vic is about to change anyway.

    One option might be to talk to the blokes at HD Development there in Melbourne. I think they import old Harley's and get em registered here.
    Might pay to visit them in person as their phone manner can be brutally "brusque".
    Don't tell em I suggested this.

    Well Pauly,   who else can he contact to get attention to his situation.  From what i see, he dping the right thing by the ADR in Australia. But they, the authorities wont abide by it.

    Probably get more interest from the "Currant growers of Australia", than ACA.
    Cant believe how anal those Vic roads people are.
    Managed to register my 84 Shovel here a year or so ago no problem. It had never been registered in Australia before.
    Reckon if you knew the right person in Vic, things'd be easier.

    Australian Design Rules were first introduced 1st Jan 1969, bikes made pre 1st March 1985 are allowed a to 100 decibels. I don't know when they started stamping exhausts but it be written in ADR's, or put stamped mufflers on bike to register it. If bike hasn't been registered in Australia it would be treated like an import. My 85 wideglide an import needed speedo changed to km, headlight, tyres etc to comply to Aussie standards. Club rego might change to 30 years old from 25 years old, a cost increase and police want you to put details of a days use on a site so they can check you out without pulling you up to check your log book. Colt at HD Development will know

    A quick story about Vicroads. A couple of years ago a I had a need to buy a new truck. Only 4.5 GMV but I have a condition on my licence called a Generic X. It means you need a letter from Vicroads describing what the condition is. Mine is I'm blind in one eye so I need to have two outside mirrors on every vehicle I drive. No problem. The finance company wanted a copy of the letter of the original sent by  Vicroads. I contacted Vicroads and was told it would take a few days. After a few days I rang  to see how it was going. I was told the letter had been archived and they needed the IT department to retrieve it. After another few days I rang the IT department to be told they needed a certain person to be able to retrieve it as it was stored in an old format. The upshot is they could not access this letter and after nearly a month of ringing them every few days I got a letter saying I needed to get my eyes tested and a report sent to  Vicroads. I asked them to write a new letter but was told no, they can only supply the original. Since then I have had to have you eyes tested yearly, and the other day I got a letter from them saying I need to have a full medical. I reckon my file has been marked as "to be fucked about as much as possible."
