    I wonder why.......So US President Joe Biden faced a grilling from reporters today as he held his first formal press conference since taking office on January 20. Not one question at that press conference about covid. The US is still averaging more than 50,000 new infections each day, which is down from a peak of over 250,000 in January, but still the second-worst rate in the world behind Brazil.
    It is also averaging more than a thousand deaths a day.What a ridiculous failure by the press corps to focus on the issue that the vast majority of Americans care about most. Why is that?

    So now the jury has retired to consider the verdict in George Floyd trial, but this process could not go ahead before we have a grandstanding pollie making the following remark/threat...." “We’ve got to get justice in this country, and we cannot allow these killings to continue,” Ms Waters said.

    “We’ve got to stay on the street and we’ve got to get more active, we’ve got to get more confrontational. We’ve got to make sure that they know that we mean business.

    “I hope we’re going to get a verdict that will say guilty, guilty, guilty. And if we don’t, we cannot go away.”
    This is from California Democratic Rep. Maxine Waters. Surely if they believe Trump incited the action that caused the Capital building any fair minded person who suggest that this is next level in inciting violence.
    Pull up a chair, America is going to go nuts again regardless of the trial outcome.

    From seeing the cop kill that guy on the video footage I'd reckon there will be less of a gerfuffle if cop is found guilty. Sure looked like murder to me.

    Not necessarily pb.
    I reckon the cop will be found guilty of manslaughter or something similar and get 10 or 12 years in jail.  Probably be out in 5.
    Dont know if that will satisfy everyone though.
    If he gets found not guilty it will be a good excuse for the natives to go stupid again.  And they will.
    Remember the Rodney King thing?  Surely that isnt going to happen again?
    Remember the OJ Siimpson thing? He was found not guilty and they all slapped each other on the back and had a party.

    Phoenix you beat me to the punch line....there is a distinct difference between Murder and Manslaughter FC. The next part to consider was there some underlying health issues that also contributed to Mr Floyd dying...well there was the fact he was positive for SARS-CoV-2, had fentanyl and methamphetamine in his system, the coroner revealed no physical findings that support a diagnosis of traumatic asphyxia or strangulation. Mr Floyd also had heart disease, hypertension and sickle cell trait. Andrew Baker, who performed the county autopsy, took the stand. In documents last year, Baker described the “fatal level of fentanyl” in Floyd’s system and told federal investigators that if the victim was “found dead at home alone and no other apparent causes, this could be an acceptable overdose.”
    Now these are the agreed facts by both parties in this case.
    The real question is....did Chauvin intentionally kill Mr Floyd...the second question is...was his health a contributing factor in his death, and as he didn't die
    of asphyxia or strangulation (as per Dr Andrew Baker, who performed the county autopsy) what did kill him?

    The cop's defence lawyers have mentioned that his actions were simply in line with the police training he had in dealing with a possible threat. In the training manual there was never any specific mention of not placing knee against a neck!
    This is his 'get out of jail card'.

    If what happened to Floyd happened to your brother, father or son I reckon you would think it was murder whatever colour your skin is. Just for the record I am not one of those bandwagon jumpers who participated in the silly BLM rallies either.

    FC just take the emotion out of the result and consider the following.....he was found guilty of the following

    Second-degree murder
        Any intentional murder with malice aforethought, but is not premeditated or planned.
    Third-degree murder is a category of murder defined in the laws of three states in the United States: Florida, Minnesota, and Pennsylvania. It was formerly defined in New Mexico (which once had five degrees of murder) and Wisconsin. Depending on the state, third-degree murder may include felony murder regardless of the underlying felony, felony murder only where the underlying felony is non-violent, or depraved-heart murder, meaning that intent to kill is not an element of the offense of third-degree murder in any state which defines it.     Second-degree manslaughter charge. Second-degree manslaughter is culpable negligence where a person creates an unreasonable risk and consciously takes the chance of causing death or great bodily harm to someone else.

    So in layman terms these would be considered and plea bargained in Australia to a manslaughter charge/charges on the grounds that the prosecution was unable to establish that Mr Chauvin planned/ premeditated to take his life. The court has ruled that Mr Floyd died as a result of Mr Chauvins actions that day.
    As to his conviction...my personal opinion is that there ae grounds of appeal. They revolve around procedural fairness and outside influences.
     The judge should have sequestered the jury in such a high profile case, considering even government officials were telling people to "If there is a not-guilty verdict in Mr Chauvin's trial, Ms Waters said, "then we know that we got to not only stay in the street, but we have got to fight for justice"
    She also said: "We've got to get more confrontational. We've got to make sure that they know that we mean business."
    Of the curfew, Ms Waters said: "I don't think anything about curfew. Curfew means I want you all to stop talking. I want you to stop meeting. I want you to stop gathering. I don't agree with that."
    These same jury members were sent home and watched these views ...hard to not be swayed by the sentiment...and that brings me back to my very first comment...take the emotion out and look at the facts. I think he will be sentenced 12-15yrs but on appeal 3-7 yrs after the spotlight goes somewhere else.
