New Bike Compliance

    Just wondering what the legal ramifications of dealers might be when they sell a new bike with non standard items on them..I see Murph is advertising one in the classifieds (not bagging anyone ,just using as an example)that is brand new with a Bassani pipe on it that looks great but surely not to Australian Standards. A lot of people get the dealers to change things on new bikes before they take them out the door but this bike is a dealer build so who would be responsible if it gets defected...No particular reason for the question,I am just curious..

    Hi Guys
    when I bought my fat Bob new from a dealer in 2015 with V&H pro pipe, i had to sign a notice that i knew it had non compliance exhaust and it was my responsibility.

    +1. Dealers can afford decent lawyers to draft such things to minimise any blowback.
    Kinda seems fair enough even though they profit from it.

    When I bought my first Harley ( in 1995 !) , the franchised dealer in WA , there was only Frasers , ALL other WA dealers were under their wing.

    You could take your new bike away with pipes and air cleaner kits installed , and the carby "Texas-tuned" to suit.

    THEN around the early 2000's Frasers in the east were bailed up by the Polizei and/or the Environmental MOFOS and lost a court case with a BIG fine.

    After that Frasers all over Australia would not "derestrict" any new bike before delivery. for YEARS and YEARS.

    I just then did my own, and all my mate's bikes as well. Commonplace. Mufflers ex-US etc etc.

    Frasers would do it for you at your "first service" as a seperate paid job requested by YOU. Got them round a loophole at the time.

    Perth HD opened , and immediately you could get yer Vance & Hines torque robbers for the day you rode out the door.

    After a coupla years of Frasers losing business hand over fist to Perth HD there was the inevitable reversal of " The Rule".

    In Frasers Perth showroom this morning every M8 model option of 2 into 1 exhaust and or air cleaner version in the showroom. Times change !
