Short of a minor offense I don't see how the bike rider could get into any real trouble unless the law is a total ass....  The driver could have slowed down and taken down the number plate - they chose to attack using their vehicle as a deadly weapon.

What about the poor third victim in this  which is now in hospital which has been caught up in this shit 

Kicking a car at speed seems a bit stupid to me -- you don't know what will happen next compared to, say doing it at the lights. Now an innocent third party is the biggest loser.
