From the QLD regulations -
Motorbikes manufactured from 1 July 1988
The distance between the extreme ends of the handlebar must not be less than 500mm and not more than 1100mm. This measurement does not include mirrors and lights. The height of the lowest part of the handgrip must not be more than 380mm above the lowest part of the upper surface of the rider’s seat. Hand grips on the handle bars must be fitted symmetricall.
Note the "lowest part of the upper surface of the rider's seat" bit. The police I've seen measuring them use the riders seat height, not the pillion seat height. I have 8" high T bars with a pullback and they are right on the limit, exactly 380mm. The fine in QLD for bars is $121 and 1 point. There is an exemption in the regulations somewhere for manufacturer fitted modification though, that's how HD get around the 10" on the Street Bob. It does state manufacturer fitted, not dealer fitted.
Noise is different, it is $390 and 2 points.
i have apes on my bike.. must agree with above comment.. i was on a rough road and my bars landed in my lap.. i didnt have access to a allan key lets just say it was a dodgy 28k ride to the closest town...
Seen a lot of Ape hangers over the years, & ridden with a lot of people useing them , but never seen any break. i used to Drag race with a mate that had an EVO softail Springer, only 80 cubic inch, he had high apes and the bike flew seen him blow off a 103 twinkie in standing quarter. it always past scrutineering & raced in the Screamin Eagle Harley's series for a number of years. never seen him change riser bolts. I'm sure if that was a problem i would have seen them failing on long runs but i still have not seen that myself.
The way i read this your Apes where above sholder hight ( 0n you ) but someone taller could be ok on the bike. Just read post above, a lot of Ape Hangers they put a bolt througe bar's at the riser to stop forward & backward slip, that 80" EVO Springer i just mentioned had that.

I would personally take the fine or the work order. Officers still have a lot of choice on what action is taken in regard to enforcement. Once a work orders isssued you have to organise permits inspections and you never know what else is going to be pinged on inspection. The height and width issue is both safety due to stress on components and maintaining safe control parameters of said vehicle.
