I was told by a pig that my Screaming Eagle Heavy Breather was illegal which I know because of emmissions etc. The new Breakout and the Low Rider S have them fitted ex factory, does this make it legal because they are ex factory like that or can the filth defect blokes? It still doesn't comply with the EPA Regs AFAIK! The dopey cunts at the stealer don't know whats going on. Just curious.

If a bike (or a car) is delivered by a manufacturer and pre-delivered by a dealer and registered then it's the responsibility of them to make sure it complies with regs where as if we modify a bike (or a car) then it's our responsibility to ensure it complies.

Doesn't mean they wouldn't try it on but even if a court didn't let you off (for a Low Rider S heavy breather) then you'd be able to take legal action against Harley Australia/your dealer for compensation/repairs/money back.

FFS how do you figure Emission is the reason?

The heavy breather allows the engine to breath back through the intake the same and the stock air cleaner so pick another reason the Police told you it was illegal.

Just keep a sales broshure of the new models with you and show the Filth when you get pulled over. It's all about attitude, you give them a serve, and you will get defected. Whether your bike is compliant or not, they can defect you as you roll out of the dealership with a brand new stock bike.

I agree with Ando here. How can the cop say an air filter is illegal? (Unless it has a jousting stick attached to it or some other stupidly dangerous thing)

Lots of old bikes came out with no air filters at all, or metal gauze mesh to keep out hunks of gravel at worst and are quite registerable to this day.

Sounds more like the cop was being "Captain Fuckstick" to me?

So what was the upshot Kaos? Did you get issued with a defect notice?

How are heavy breather air cleaners illegal?

Open pod style filters are supposed to be enclosed when under a bonnet to prevent fire risk (and should ideally be insulated from all the hot stuff under a bonnet anyway) but never heard of a pod air cleaner being an issue for a bike. I've had past bikes go thru the pits before with them on.

Look up the australian design rules online and text search as appropriate.

This shits no diffrant to cars which have had this issue for ever if it modified or not Oem std fitment you can get done that's why thay hand out permits in wa anyway if accepted after you hand out more coin of course, but if it std fitment on that modal not after sales out of the Harley parts book I would fight it , It's obviously taken longer to happen to bikes

I get the noise reasons for pipes being illegal but not Air Cleaners.  They will say it is part of the emissions system but how the fuck would they know whether it doesnt still meet the emissions standards for that year?  They wouldnt until they start sticking Emissions testing equipment up the pipes at rego time like in the states.  Mine is obvious its not stock and Im not going back to OEM unless they threaten to impound it.  Ill take the ticket.
