Frame Damage from new

    If the dealer has acknowledged that the damage was caused prior to sale by a forklift, then they should bear the cost replacing the entire product. Does it matter if it is an expensive motor bike or something less expensive?

    Would you purchase the product knowing that it was damaged? No is the logical response. So in my mind the dealer should swap the damaged product for an undamaged one. Hard lesson for everyone concerned.

    It does not have anything to do with warranty which applies to after sales defects, not prior damage such as this.

    How does it run from cold? If OK, perhaps coil breaking down as IT gets hot. If so, try cold start having heated coil with hairdryer before starting. Does it now run badly from the start? If so, swap coil out.

    Just went for a ride to charge up the battery now the battery only has 10.5 volts and won,t kick over the starter. How do I check the altenator charge? Leftyden

    Ok so HD has passed it on to be the dealers problem, they have offered to replace the 2 shocks and get the frame repaired and painted, thing is the body works shop has told me if they can't get a gun under the bike to paint it, they will need it as a bare frame :( and I'm sure the frame is powder coated not just painted....

    I gave the body shop strick instructions that my bike is not to be stripped into a million bits and if that's what has to be done to repair it then don't start the job.

    The way I see it is you will NEVER get a new bike out of this.

    Have the frame painted/repaired (by a decent motorcycle only paint shop if you can find one), fit the new shocks and then put it
    behind you and enjoy your new bike.
    And also push them for a free service or two.
    Do not let them remove the frame !

    So no help as such from Harley.
    I'd be fucking pissed off if I had just spent $30k or whatever on a supposed new bike and it had frame damage,(which it has). I'd take this to the Department of Fair Trading, FFS, mate and quote the Value of the product Vs How long you have had it.
    I get it thrown at me from time to time. Harley do a lot of advertising and dont want to throw that money down the sink on something as TRIVIAL as this. Advising Harley US might be an idea as well , though the damage hasnt been done by construction.
    If you have damaged it and are trying to get it done under warranty, forget all I've said.

    Ok I have been in contact with the office of fare trade, they have said I as a consumer are entitled to ;replacement, repair or refund..... And that in this case a replacement isn't un reasonable... As I wouldn't have accepted a new motorcycle that has existing damaged to it. I now have to put it in writing and email the dealership..... I was told repairing doesnt seem like an option as it has to be stripped down to a bare frame to be repaired properly.

    I understand what you are saying and I value your opinion... It's sort of the principal of buying a Brand New bike that is damaged before delivery.. There for its not brand new. I am willing to compromise to the extent just b4 they have to strip the brand new bike that I've purchased down to a bare frame. I didn't buy a 30+ thousand $ bike just to have it stripped down to the frame. It will never be the same again. Yes if I had of done it, totally different story I agree, but I didn't do it and I've purchased a brand new fatboy that is damaged, structural damage, not like its a front or rear guard that can be unbolted and replaced.
    I don't want to have to put the heavies on the dealer I was just finding out my rights as a consumer.... They are the last resort if the bike has to be stripped down... That is where a replacement should be organised.
    I still want to be able to do business with the local dealer.
    Like I've said the dealer has said it looks a forklift has done it and HD Australia said the damage is consistent with a lifting device.
    Re spraying the frame while the bike is still together runs the high risk of overspray on other parts of the bike ie; chrome wheels, transmission and even the paint work. This is also y I'm a little concerned about repairing it. And it's powder coated and the bike shop is offering to get it sprayed in 2pac, will that last like the powder coating???
    Yes I am a little stressed about it coz it's not every day Ya buy a new harley and this is my first one, so it's kinda special.
    I just want to get on it and ride, it's really frustrating coz I love being on the bike.

    Looking at the gougues / scratches. They do not look to old as no surface rust / discolouring has started. Yes definitely Ask for New Shocks, just incase they are damaged in anyway. But the Frame I would be happy for it to have the rough edges filed and repainted ( and yes they are baked it an oven, but just about All painting is these days) Maybe ask for the next 2 services for Free or something like this. But just remember to be Polite and keep your Cool.

    Basically what they are all saying mate, is that your fucked.
    That being the case, go along with the repair and if you ever buy a new Harley, make sure they put it up on a hoist so that you can inspect it before you buy.
    As far as I can see from this tread, anyone that buys a new Harley you should do the same thing.

    It's all sorted out now guys... Took a bit of constructive persuasion but I got a new bike out of it... Because the paint shop wanted a bare frame.... Happy Days
