You know what I would do if I were in this position...

Tell them to go ahead, and then refuse to pay. When they won't give you your bike, call the cops and have your rego papers on you. The cops will demand they give you the bike (as you are the rightful owner) and they will be left to chase you for the cash.

I have seen this done. :)

There is also Implied warranties, see blow, this warrantly is a warrantly that the buyer should expect a product to mantian a useful life under normal use, usually  beyond the normal manufacturers warrantly period. No I'm that an expert in this area, but I have used it in the past with great effect, with electrial goods.

    http://www.commerce.wa.gov.au/consumerprotection/content/Motor_Vehicles/Buying_and_selling/Buying_a_vehicle/Implied_warranties.html

Usually all it takes is to say Implied warranty & they come to the party, if they don't you have the option to go consumer affairs & ask for a ruling.

I know this is about  HD & a dealer not doing the right thing with a bike under the 24 mth warrantly, but it may be useful for those of us who have been screwed by HD after a bike is out of their warranty.
