Qld 'Bikie Laws' survive High Court challenge

     I hope they have the resources to appeal the high courts decision, if not the flow on this could and probably will affect all of us, This country is going down the tubes it wont be long till all our rights will be eroded, it's a sad day for this country.

    Unfortunately I dont think appealing the High Court is done very often. In effect this decision means that the Qld Supreme Court now has the ability to hear the case...even using 'secret evidence'. Now how seriously the Court will take some of that 'evidence' only time will tell. It is possible that appeals on the Supreme Court findings could come up in the future. Part of the authorities tactics could well be draining the resources of these groups, it is a well known legal adage that goes something like 'getting the justice you can afford, but not necessarily deserve'.
    I doubt the decision will deter the Clubs will to continue the fight.....as has been said many times before...If they get to censor friendships among Bikers, then who's next ?

    its a joke. when are they going to unfurl the swastika banners at parliment house in canberra & be done with it. make it clear for all australians what we will be fighting against.

    Pretty sure thats exactly the response the Govt strategists are hoping is widespread..... Pick an unpopular target, con everyone that these laws will only ever be used on that target......and, if successfull with that ruse, gleen plenty of votes next election.! Luckily most are smarter, people like DPP Nicholas Cowdery, The Law Society, The Bar Association and many other eminent Jurists among that group.

    definitely the thin end of the wedge, i find it so completely offensive that the govenrment feels it has the right to tell you who you can be friends with, fuck that, im my own man always will be and will always be defiant in the face of this socialist bullshit. makes me wanna go join a 1% club just to add weight to the numbers against this unaustralian unconstitutional crap

    Well that sounds fucked ><. I choose my friends not the fucking government. I am not a member of a 1% club but telling people who to associate with is the begining of the end. If they are serious about drugs go after the fucking Drug Carlets of Asia and South America! Not this bullshit via targeting a scape goat. I work in medical research and number of the people doing construction work on my lab are 1%'s! what I am trying to say not all the 1% are drug dealers they are people too with jobs, lives and there are good ones and bad ones. What the government has done is lump them all together (me included too I guess from the governments point of view-purely based on how I look).

    Makes me want to move to Mars.

    How fu/cking stupid are the various state governments (puppets) and the federal government. FFS even a stupid cu/nt knows all you have to do is follow the money trail to bring down any criminal organisation. Just lazy hypocritical governance.

    By the way the laws are not just for the 1% they are for everyone, but I don't see the cops/politicians targeting the "love you long times" in the illegal sex and drug trades.

    Here in SA if you do not have a club/tattoo/patch/clothes and you dont ride you can not be "declared" and hence subject to control orders. People are not stupid. So now we have a "new" 1%ers driving cars without patches/tats etc. Now you don't know whom your dealing with. Seems as fast as the law can be changed the quicker people can bypass them.

    So the end result is the supposed bikie problem gets driven underground, so it is less visible to the average joe then the pollies will stand up and tell the faithfull how wonderfull they have been.

    And to think our predecessors fought tooth and nail for the legal right to associate with whomever they wished.

    And ponder for a moment why the boys scout movement has not been declared because there sure as fu/ck some sick criminals that our society should be protected against. End rant.

    Edit: You would not be able to talk publically (including forums) about most of these topics under the proposed government media laws. Tell your friends and ring your federal member and tell them they will be voted out if they support them. Do it now, so you don't complain later. FFS.

    Facts are the clubs are there own worst enemy ,, I know guys who have been on the edge of the scene with various clubs for years and years , who now shy right away , don't want to know or get involved ,The last 20 years things have changed

    if its the 1% of the 1% clubs that are causing the problems . Then why don't they get rid of them, have a clean out, and stop recruiting them .. They don't have to become angels , just cleanout and become bike clubs again

    Facts are the clever little shits that drafted this Legislation included sneaky sections that allow ex members AND associates (from as long ago as they wish) to be included in the Declaration application ! So in effect a Club could have none of its criminal members, who's records legitimise the declaration, active anymore. These sneaky little Govt legal eagles predicted the Clubs may do exactly as you suggest to circumvent the criteria.
    Its not as simple as it seems, the use of 'secret evidence' now means any bit of gossip, inuendo, or suspicion of anything criminal can be used AS EVIDENCE and Club members, ex members, associates and Lawyers cant know what that 'evidence' is. Very hard to answer an accusation when its a secret eh....
    As you point out boxa some things have changed for some Clubs, but not ALL, and that is the rub, blanket legislation always gets it wrong here and there, good legislation should protect the innocent, even amongst the Clubs, these Laws do not..in fact they target the friends of the misanthropes. If my children were nefarious little fukers I would be pissed, but they would still be my children, welcome at my house anytime and no Govt could tell me to cast them adrift, otherwise what sort of patriarch would I be, my brothers are my family too...

    GG ,, Your correct in what your saying , theres no doubt in my mind that over a period of time these laws when there brought in , and they will be, will be used and abused , and most will say why did we let them in .

    But the thing is , Mr Joe public does'nt want to hear guns going off in the stadium , outside restraunts , he does'nt want to see scary looking guys with tatts on there face , threatening to do bodily harm to others , or pictures on the 6 o clock news, off clubbies being beaten and threw off cliffs ,kids shot while in bed , and the list is endless.

    So it just gives the politicians what they want , the ability to bring in these laws , and the police extra power to enforce laws , when what there saying is illigal theres already laws against .

    Most with half a brain who sit and think, can see whats happenning ,, but like i said over the last few years instead of relizing it , and putting a stop to there members doing these things , a lot of 1% clubs have refused to fly under the radar , and become higher profile, and i'm afraid they now gain little or no sympathy from the general public .

    These laws will mean the end , of a lot of clubs , it won't stop crims , drugs and guns ect ect ,, but it will make it easier for the cops to do there job ,, its the oldest war tactic in the world ,, DIVIDE and CONQUER .

    Maybee theres still time yet for the clubs to get these laws watered down at least , but without public sympathy , they have no chance and like i said they have been there own worst enemy .

    You make your points soundly boxa, there's no doubt the antics from the radicals in and around the clubs are the measure by which all are judged.....whether that be fair or not. The chance of any sympathy from the general public is not only gone , it was never really there.
    Representative groups like the UMC realised right from the start that winning the hearts and minds of voters was not ever going to happen, nor should it, Clubs have traditionally shunned approval by mainstream society so to change now would be hypocritical. But what was needed was funding to attempt to win the hearts and minds that really matter... Judicial minds.
    Now while many clubs support the fundraising events tirelessly, some members reveled in the heightened media circus surrounding the whole subculture and strut their stuff as if its expected...not smart, and certainly not legal, but hey, clubs dont have exclusivity on doin dumb shit even while under scrutiny. Maintaining lawfull behaviour is a job for well paid enforcers. You only gotta look at a certain organisation thats the subject of a Royal Commission in Melbourne this week to get my drift boxa.
    The lobbying undertaken by groups who oppose the new trends in legislation against Clubs is not to protect the active villains, but to protect the many members who aren't.
    This view is a simple one, The investigation, apprehension, prosecution, conviction and incarceration of any lawbreaker, Club linked or not is undeniable, we concur...... BUT, the imprisonment of friends, family and associates for maintaining nothing more than a friendship deserves resistance.!
    It is highly unlikely association laws will finish off any Clubs, its much more likely that imprisoned Clubs will simply congregate in prison, form stronger bonds with more and more villains and the cycle will become worse rather than better for the community. The anti-association 'Special Powers act' in Ireland imprisoned nearly 2000 students accused of being IRA supporters in Long Kesh internment camp in the early 70's......long story short, sympathy and support for the IRA grew as a reaction to such injustice, by 1974 the Act was repealed and students released.
    It is highly unlikely our Laws will be repealed, but it is extremely likely the imprisoned groups will become far more criminalised than they may be now....... certainly not the result the Pollies are espousing.

    I was always under the impression that the Clubs were a Social Club and registered as such....
    The Government obviously dont have the power to remove Social Club recognition in this
    country or they would have already tried.....
    The thing that anoys me personally is that roughly 80% of the 1% clubs are of "Overseas
    Interest" and there is not one Australian club that I know of that has any kind of "Emblem"
    that promotes Australia in there insignia.....
    The only way out of this that I see is for one of the major clubs to do a "Big Company"
    rebrand / overhaul of the insignias used in these modern times so the insignia and badges
    actually represent something Australian.....
    The other problem that I see for the Government is the amount of "Patched Members"
    in these clubs now must be in the thousands, all well armed and cashed up, we are only a
    small country compared to the rest of the world with a very small military, if there was an
    uprising in Australia or a Foreign Attack the clubs could then band together and become a
    real threat to the stability of the Government....

    This is just my PERSONAL THOUGHTS on the matter and im not trying to ruffle any feathers.

    Interesting times ahead , thats for sure GG .. how its going to pan out regards the future of 1% clubs who knows ,, but its been well documented that the structure of clubs is not the same has it used to be They may well use these laws and put some in prison , there will probably be like you say, even stronger bonds formed ,,

    But by and large , i think they will get a lot of results they want , simply because the structures changed , and the bonds and values of the old fashioned clubbie , have changed ,.

    These laws are directed at , costing the clubs big time and stripping down there assets , Times have changed , and the older smarter guys knew that you can do what you want to an extent , and its just you against the police , and if you flew under the radar thats how it stayed.

    But once you start stepping over the line , and Mr Joe Public starts to become fearful then the police and the govt have no choice but to step in and have a go , and ANY club or organization is going to lose , because they have the biggest gang in the world , they have all the money , and they will just do has there doing now , change the laws to suit themselves .

    , i do agree though with someone elses statement , about the ullyssess , they have 15-20000 members , that would of been an awful lot of votes to scare the pollies , , ,

    Thats my Rant over ,, i somehow , think if the different clubs , would have had and instigated A LOT MORE , POLITE DISCUSIONS LIKE THIS ,,, they may have done themselves more justice , cheers mate

    Thanks for the input boxa, as I said earlier your points are sound and you put them well, they are exactly what we are up against...but we have no choice but to resist, Cheers.
    Wayne.craft unfortunately social club registration doesnt exclude a Club from Declaration, many of the Clubs are incorporated bodies as well but the cunning legal scribes that put together these Laws covered ALL the angles to avoid prosecution...even being a religeous group. No wording in these Laws mention Club, Gang, Bikie, Motorcycle Club nothing, all they refer to is 'group' or members of a group'. So even though the public believe only Bikers will be affected, the truth is anyone can. Im not sure exactly what you mean by rebranding Australian, each Clubs insignia has a meaning to its members that is not geographic and as I mentioned before there is nothing in the Laws that say or even hint at being patriotic based excludes prosecution. In fact the one Club that is before the Courts now in Qld is an Australian based only Club.
    The Federal anti-terrorist laws that were instigated in Australia after 911 are the forerunners to these anti-association versions, things such as 'secret evidence' the reversal of onus on innocence etc were drawn from those pages, I doubt Clubs would head down a civil unrest pathway...it could lead into terrorist branding. Many experienced Legal experts claimed that 'no rights' anti-terror type legislation once enacted would eventually seep down into common law and directly affect the citizens of that land.....they were right.
