    Smacks of small town cops using the law to their advantage. I suspect 2 things. 1) they will be getting some heat fro using these laws to their advantage and outside intended purpose. This stes a precedent for the anti legislation lobby that seriously undermines the Govt. 2) The 3 wankers interviewed are complete scumbags and deserve to be locked up. The 1 clown who has been in the can 7 time " I learnt a valuable lesson each time" what, to be a better crim? Frankly, whilst the use of this law in this case stinks, I only feel sorry for the Mum.

    It used to be the same in W.A. many years ago...they'd pull up at a favourite meeting place, & half the people there would get done for consorting. Bloody joke. (I think they eventually changed it?)

    Lets play devils advocate here,, The mom says its not his fault he had a hard life ,, sat outside pubs waiting for his old man ,, Err hello , they think there the only one .. I know has a kid if i wanted to find my dad , i went to the pub . Yep and from 8-9 years of age i wanted my tea , i stood outside waiting for my mam to bring a bag of potato chips out , cos she was with him ,, friday night treat get 50 cents and told to fuck off home and get a pastie and can of coke .

    His mom says He could'nt read at 13 , so its not his fault ,, my neighbors kid went through primaty school and got into HIGH SCHOOL ,, when the literacy exam, the teachers DON'T WANT picked up he cannot read or write ,, so the school brought in a special tutor , paid for by the education dept. Why don't she take the blame , fucked if i would off let my kids not learn ..

    She says , he got in with a bad crowd so its there fault ,, then in the next breath says why can't he be with these mates , he's known them since he was a kid ,,, Once again its not my little Johnny its everyone else's fault .

    You know what these laws, WILL NOT , do a thing for the hard core crim or the real hard core 1% ers

    But , them 4 look to me like a typical bunch of lazy facking yobs , 21 on a disability , get real , get a tutor and learn to read, , 23 in jail 7 times , Yeh,, nice bloke,,, you lot can feel sorry for them but to be honest , the victims of there crimes will be glad .

    They come to my house looking to rob and plunder for drug money , well they will get a shock , cos i'll fight back ,, but the guy up the road who's never had a blue in his life , or your aunty Mary who is a real nice sweet old lady , well they will be shit scared and become a victim..

    So am i to feel sorry for a thug, who the law wants of the streets getting 12 months,, AM I FUCK .

    iN FACT SOME COULD ARGUE THAT SOME GOOD CAME OUT OF IT ,, BECAUSE ONE OF THEM SAID , WERE HAVING A BABY I WILL HAVE TO CHANGE MY LIFE AROUND ,, now if he does then it was worth it ..

    Police and politicians have been forced back to the drawing board in their fight against serious gang-related crime after a single Hells Angels member succeeded in having NSW's tough anti-bikie laws scrapped.

    In a remarkable legal challenge which could have national ramifications, Derek Wainohu, a Sydney Hells Angels member, asked the High Court to declare the Crimes (Criminal Organisations Control) Act invalid.

    The law was introduced in 2009 by former premier Nathan Rees, just 12 days after bikie associate Anthony Zervas was killed during a mass brawl at Sydney Airport.

    The Law Society of NSW said at the time the legislation was an over-reaction.

    It effectively gave the Supreme Court the power to outlaw bikie gangs and force members to avoid contact with each other or face up to five years' jail.

    But in a verdict on Thursday, the full bench in Canberra agreed with Mr Wainohu's assertion the law could have impinged individual freedoms.

    The NSW government has been ordered to pay the full legal costs in the case, which Mr Wainohu's lawyer Wayne Baffsky said amounted to about $300,000.

    "We're very, very happy," Mr Baffsky told AAP.

    "It's not just for them (Hells Angels), it's for the people of NSW. Because the extent of the law was extraordinary.

    "It was a frightening act in my opinion that targets two or more people."

    The United Motorcycle Council NSW welcomed the ruling, as did the Brotherhood Christian Motorcycle Club (BCMC).

    "We believe that the legislation was exceedingly dangerous for the whole of Australian society," BCMC spokesman Greg Hirst said.

    Law Society of NSW president Stuart Westgarth called the former law a "reaction to a particularly nasty situation".

    "We put forward a number of objections to the legislation," Mr Westgarth said.

    University of NSW Faculty of Law senior research fellow Christopher Michaelson compared the Act with that of a dictatorial regime.

    "I have great concerns about laws which criminalise membership in organisations as opposed to individual criminal behaviour," Dr Michaelson told AAP.

    "This is much the practice of dictatorial regimes with little regard to the right to assembly and freedom of organisation."

    Police Association of NSW president Scott Weber said the law had problems from the start.

    "So it is not surprising that the High Court has overturned them," Mr Weber said.

    Police should have the same powers as the NSW Crime Commission to investigate unexplained wealth and earnings of organised crime, saying this would be a better way of combating criminal activities by bikie gangs, Mr Weber said.

    NSW Attorney-General Greg Smith said he would now look at new legislation.

    "We will examine whether legislation can be prepared which will adequately address the concerns of the High Court, but will not allow this decision to slow the NSW government's crackdown on organised crime," Mr Smith said in a statement.

    In their ruling, the High Court judges agreed with concerns that the anti-bikie law meant normal court procedures could be bypassed.

    Their concerns centred on the fact that defendants could not appeal decisions made under the Act, the provision for hearings to be held in private and the lack of regard for the normal rules of evidence.

    The judges said the Supreme Court would be asked to make rulings "without regard to the rules of evidence", based on information not disclosed to defendants and with no obligation to provide any reasons for judgments.

    NSW's anti-bikie laws were partly based on legislation in South Australia, parts of which were ruled unconstitutional in 2010.

    Politicians in SA were watching the NSW case closely.

    SA Premier Mike Rann reiterated his vow to keep up the fight against bikie gangs.

    "We do not resile from what we're doing, we're going to keep coming at them," Mr Rann told reporters.

    "The bikies might think that they got a free kick from the High Court but they will not be getting a free kick from us."

    I'm not surprised one bit, nobody bothered to dispute the law before it came in. Same thing will happen with the day glow vests in victoria next year. They keep putting in laws to take away our rights, and we let them.....

    I think the authorities played a very clever card by using this crew of deadbeats as the precedent case. Not only are they career felons who get nor deserve any sympathy but they are broke.

    Now whether these facts played a role in this case we will never know..the authorities are unlikely to confirm,  a  denial is much more likely.  But this whole anti-association campaign has hinged

    on minimal scrutiny because of it's unpopular targets unlikeliness to draw much public support......  rather than monitoring the proven dangers of this legislation previously experienced around the world

    Originally I think the authorities counted on the 1%er's unpopularity as its major tactic.  The rise of the UMC's, 2 High Court spankings,a sometimes inquiring media and denouncement from many

    eminent jurists regarding the potential for abuse of such draconian legislation has become a stumbling block for vote hungry pollies. Re-directing it against misanthropes beyond sympathy

    re-works another angle, they can spruik  'its not a discrimitory law now, its not just for bikies'.......... Either way  the gist of its potential to be used inappropriately, or corruptly, doesnt change

    no matter how much they change the players to throw us.  An appeal on this case is now destined for the High Court too, as it should be, not because the cretins involved deserve it......We do..!

    The government appointed solicitor wants the 1st person charged with anti association legislation law to become a test case without testing it.

    And I bet it was in the district court to become a precedent.

Gillard that stupid ranga has to get off her fat ass and stop taking political advice from Kim Jong Un. What is this country coming to. I have already had issues being hassled by these dicks about "associating" with people and I have very happily, and will continue to, tell them to go and fuck themselves. No one is going to tell me who I can and can't talk to, spend time with and LEAST OF ALL RIDE WITH. and I hope everyone else is the same. Dont ever let someone control how you live your life. I'm not bothering anyone. The straighty-180's don't seem to have a problem. If there;s no complaint then whats the problem? If not for Wayno this kids spending more time in jail for hangin out with his mates than ya do for assault.
