Have I been ripped or what?

I bought a new HD last year from a dealer.  I got the exhaust/filters etc changed from stock, and the race tuner.  That orange box thats suppossed to make eveything run correct.  It all cost a fortune.  The bike was missing a few things that I optioned (pegs, indicators etc)  and the dealer denied that I ordered them, and failed to locate an itemised list of my options. Anyway, thats another bloody story.

My brother, at the same time ordered a triumph from the same dealer. Air cleaner and exhaust mods too, like me.  They said they'd "tune it to suit".

Well both bikes have been backfiring etc.  So he took his Triumph to an independent guy for inspection.... The tuning was stuffed.  The brakes hadn't been set up correct, parts were loose. It was gross neglegence.  The entire bike needed adjusting.  Its beautiful... now.  Runs like a dream.

Heres my question.  What have they done wrong with my bike?  Its backfiring still, but i refuse to let those bastards touch it.  I think I've paid for a race tuner thats never left the box.  REALLY fuckin' pissed off.

Had first service.  They ticked all the boxes.  Funny though, the horn was never working and I forgot to tell them.  Yet they ticked the box saying it was working.  Do they just tick all the fucking boxes for fun????????  They never even checked anything!!!

Can anyone recommend a place in Melbourne to get my bike serviced?  Would be much appreciated, cheers

    Felix

it has warranty, take it back
you would have a copy of the order, find it and take it as proof, your payment receipt should give you a clue what you paid for, at least what you got
    accc is your friend

    Hi Felix!

I'm sad that your first post here is tarnished with a bad experience, we can offer some advice and pointers.

Firstly, check out this and click, read and click some more while reading and even read while clicking, there is alot of correct information there:  http://www.accc.gov.au/content/index.phtml/itemId/961880   That is direct from the ACCC website which relates to "services" and your rights, as well as their rights.

Basically, if you want them to do something about it, they have to get the chance to actually do something about it; they will need to touch your bike.  If you don't want them to, thats fine with them, you get the chance to then pay for anything that somebody else does as your "warranty" lies with the seller or provider of the service.  You could try to sue them for the costs but chances are it will be denied because they never had the opportunity to know that there was a problem and therefore never had the chance to fix the problem.

Your brother has done the smart thing by getting someone else to look at it and fix it, but the costs for that are his own costs for the same reason: the "dealer" never had the chance to fix it.

Even if the dealer was negligent in providing the service and have ticked all the boxes, if they have not done what they said then that just means they are dodgy and need to be put on notice that it is known that they were dodgy.  If, after putting them on notice, they have still not fulfilled their obligations (which forms part of the contract for services and/or sales of the products to begin with) then you can raise a claim through the Dept of Fair Trading or lodge a complaint with ACCC.

    Good luck mate!

    Cheers,

    Shred.

TL;DR:   Call the dealer, tell em ur pissed off about it and tell them to fix it before you start lodging complaints, claims and writing letters to Mr HD and Mr Triumph...

    EDIT: Spelling.

    Na its fair dinkum.

Im sorry if you get a few bullshit stories, but dont judge all of them.

Im just angered after spending 35k on a bike, my bike isnt taken seriously by the person i got it from.

And would you believe the warranty is void because I cant get the 12 month service done due to the fact Im working offshore?

Regardless of these problems, are there any places someone could recommend to get my servicing done?

    Hello Felix,

My name is Ant and I am from a dyno tuning shop in Melbourne, I also am a HD enthusiast and see more of the issues that you are having than I care to mention. As Henry told you I do not service bikes but definitely tune them and favour the Screaming Eagles units.

As you have already been messed with by others, I will offer to you what I offer all of my tune clients. Bring me your bike, I will tune it, if you are completely happy, pay the bill, if you are not, I will return your bike to the way you brought it to me and it will cost you nothing. The SERT is an extremely capable system that HD promote for use on their bikes, there is no reason for any popping, flat spots or poor fuel economy.

Hope it can be of help to you and you can begin to enjoy your Bike!!!!

    Regards- Ant

Hard one ,,, On the one hand you don't want peanuts to touch your bike again ,, on the other hand you have to give them a go at fixing it , Go with what Luke said ,, drop him a email and let them sort it out ,,,

And to be honest where your talking about is a big mob , and they will have a few peanuts working for them , so let the management know your not happy and WHY after all one or two peanuts could be costing them thousands and untold damage to there name .

Crikey IMHO a lot of people put far to much trust and confidence in a dealer warranty, how many new Harley's with pipes and tuner etc pop on decel etc from ALL dealerships, this means there are not tuned right from the start, so what is the point of taking it back to people who don't understand how to tune them correctly.
