I really struggle with this one - seems like a csase of not taking responsibility for your own actions.

No mention of the fact he had the accident - ABS  is an avoidance device i.e it helps drivers/riders avoid a crash NOT prevent it - The rider has some reposnsibility and is he really saying he was so stupid as to not know it did or didnt have. Maybe he shouldnt be riding in the first place.

You know the sad part is this cost of defending these actions eventually finds its way into theh cost of new bikes.

The single biggest probelm with common sense is

Man, that is so sad about his wife. I'd be surprised if he won though. I think a smart HD Lawyer could successfuly argue that ABS or no he could not have prevented the accident. If not a total exonneration, then certainly lessen the damages to HD.

We don't know the facts about the accident, but it would be difficult for the Rider to prove he was capable of fully controlling the bike in the situation that occured. I haven't worded that well at all but I'm trying to say HD could shoot plenty of holes in his story.

And the Winnebago thing - I thought that was an urban myth. Did that really happen?! Surely no-one is that dumb?

EDIT: I just checked the Winnebago story on the SNOPES site (urban legend stories) and they have it listed as a 'legend' story - as in it's a very well known bullshit story but oft repeated as fact. But that's if ya believe SNOPES...

Well my ABS just failed on the rear brake leaving me with no brake at all. The pedal was locked and would not move.
Lucky it was only the rear brake and still had front.

It's a design fault and $2000 to fix with a new updated part and ECU to suit cause it won't work with my old one. Another Harley Davidson RIPOFF!!!!!

I wonder if she was wearing a helmet?
Having an ABS on the cluster I have to admit is a bit shonky, similar to the speedometer on the American Toyota Yaris, which says the tiny car can go 140 miles per hour.
