Hi All,
Not a good day for me.
Got a call from Harley haven at 1:45pm this afternoon. and got told the price for 48 has gone up by $1,600 (about there, dont remember the exact figure, as i am in shock). Now, I have paid the deposit ($500) back 2 month ago, and they are telling i still have to pay the increased price even though i have already paid the deposite base on the old price!
Now, what can I do? I just think this is really unfair!
anyone in the same boat? did you have to pay the extra? There is no way i am going to.

Without knowing the full details, when you paid your deposit you have entered into a contract with the seller to purchase the product for a certain price. As a goodwill gesture, you paid some money up front to secure the product once it arrives and will pay the balance in full when the product is ready to be supplied. Their part of the contract is to supply the product for the original price which you both agreed on. If you have an invoice for this then stick to your guns and insist that you get what you paid for as agreed.
The flip-side to this is that they may say that the 2011 48 is not the same as the 2012 48 and they cannot supply the 2011 model hence the new model is a higher price. At this point you are entitled to a refund of your deposit and that may be your only recourse except to pay the asking price for the new model.
IMHO, you've waitied 2 months so far and still no sign of what you paid for and now they bring up a new model for a higher price which sounds a little unfair. Talk to your state Office of Fair Trading and find out your rights.
I would tell them to stick it if they pulled that stunt on me
I wouldn't be surprised if the 2012 sportys are coming with ABS, far as I recall its mandatory in Europe from 2012 onwards?
As everyone says they are bluffing you. There is a 3 month wait for the 48 so they are trying to cash in like with the 883. They would have given you a receipt for the deposit, which is good as a contract for an agreed price, otherwise you would not have left a deposit. Just mention dept. of fair trading and they'll have to think twice.
Before I fire you up too much, take a few things into consideration based on my analogy.
I live in Cairns, Far North Queensland.
If my Dealer says "dude it costs this much" I can whinge, whine, beg and hassle but at the end of the day, how much it costs depends on the person selling the item. They own the item, I want the item, I have money, they want money and the rest is negotiations.
In Cairns, we sometimes feel like we just got running water and 24hr electricity, some of us can even reand AND write too. In saying that, we have 1 dealer. If I piss off the dealer, my next option is Townsville, only 500km's away. Perhaps Mackay, which is a fuckload further away. I have the internet to help me, but its not quite the same as walking into a dealer and reminding them I just put a big shiny wad of cash in their till.
Talk to the dealer, talk to the ACCC and Fair Trading mob. Find your rights and negotiate something.
If you have other dealers nearby (not 500km's away) then perhaps try them out and see what they reckon, they want your business too - refer the part about them owning and wanting money etc.
play their game, and only agree verbally, when bike arives only pay what is on contract, if they say you agreed to pay the higher amount ask to see where you agreed to it? not in writing? stick it to them, i'd be so fucking pissed if they pulled this bullshit on me.
Edit : i think my post is now void due to "Price subject to change without notice" thats where they fucked you.
The cost of bad advertising is worth a hundred times of that of good advertising. Unfortunatly......it cant be measured, which is why they still do it. This leaves a bad taste in my mouth, and should do to others as well. Gone are the days of the 'hand shake' I know this, I dont welcome the days of 'Fuck you or anyone for a dollar' Its a pity they wont know how much $$$ this thread will cost them ultimatly. Good luck and keep us posted.
Where's our old mate from Harley Heaven that posts on here?
Maybe he can shed some light
Freakin HD dealers are all the same in OZ. No wonder they are so despised, big company like that trying to rip off the little man. I run a business and on many occasions have made a lost to keep a customer happy as I know he will remain loyal to me. I even put up with rude, annoying, ungrateful SOB and pretend I like cause the keep on returning to my business. They might make an extra $1500 out of you, but they have lost you as a customer forever, which would equate to many times that & also any potential friends which you would recommend the business if they had treated you as a valued customer. Trust me it's a big bluff, personally I'd pursue all avenues to get it at the agreed price. You have nothing to lose as if they can't honour that price they'll just refund your deposit & then go and give your hard earned cash to someone that deserves it. I've seen a few second hand 48's up for sale so maybe even go that route and you wouldn't have to wait the 3 months either.
I have just ordered a 48 so I have been reading the forum for tips and thought I would join up when the bike arrives. This issue has happened to me too so this is my explanation from the Dealer:
I paid my deposit at Peter Stevens in Adelaide and asked for a 2012 model. They called me 2 weeks later and explained all Sportster models have increased ($800 - $1500 depending on bike). They explained that the 2011 models will be the same cost and only the 2012 models will go up in price. Supposedly directed from the factory so their hands were tied.
I was waiting for the 2012 model as it is due in Sept and knew I would not get much riding done between July and Sept if I went for the last of the 2011's. I have now changed the order from a 2012 model to a 2011 arriving in July. They held the original price for the 2011 model.
It sounds like the dealer if shafting you if you are getting a 2011 model.
Also a quick explaiation on 2011/2012 model compared to 2011/2012 build. I work for Holden and we have exactly the same issues with customers. Usually the next/new model year will start in approx Sept every year. For example Harley's 2012 model will be available in Sept 2011 with a 2011 build date. If you want a 2012 build plate you would have to wait for a Jan build bike and I guess it would probably arrive in OZ for delivery in Feb. Customers get stuck on this all the time and it is the Dealer's responsibility to explain.
Hope this helps
