If you put it in correctly it shouldn't leak.

When preparing a new filter alway put a film of oil on the seal before installing the filter, always make sure the surface of the filter housing is clean and dry.  Install the filter hand tight only, if it is over tightened the seal will deform and leak.

I would replace the filter if it is tight as the seal maybe deformed or have some crap on it.  Filters are cheap compared to a new motor.
