A strange situation

    Hi guys..

    Work this one out.....I am seeing a Lawyer about this as something just doesnt make sence to me.....Check it out..

    I had just rode 700ks straight from Surfers Paradise....Got to NewcaSTLE abnd HB (bloody woman) whom i was following took a left instead of a right.....So in a 60 zone she pulled into the curb and i changed lanes doing about 5kph to pull up a few car lenghts in front of her....As i was about to pull into the curb i heard screaching behind me getting closer and closer then the "oh shit moment" when you realise I'm gunna get hammered...So eventually the car behind me hit me from behind on the right side of the bike....I don't remember anything else until i woke up middle of the road when a car ran over me.....(i refused while on ambo stretcher to go into the ambo until i had a smoke so here i am on the trolly puffing away with paramedics arms crossed waiting for me to finish lmfao)    Guess you had to be there but it was funny...I had bones sticking out in directions they r not meant to be in lol....

    Get to the ER and are told that i could die at any moment so spent a while in hosp....But i wouldnt get into the ambo till i knrew the Blingmobile was off the road....Funny the things one thinks about at these times...Here i am broked to pieces and all i cared about was me bike.....(dickhead i am)....So my wonderfull HB stayed with the bike till Harley Assist arrived to get it then she came to the hosp....

    Now this is where it gets interesting...

    There were 2 whitnesses. Both had conflicting stories so cause ,as the police said " he's only a bikie" he decided he would take the account that said i had changed lanes not give way and thats what i was charged with....Not a neg drive just that...Now, The cars skid marks which thanx to Bano HB filmed and took pics of was 32 paces which she paced out with the Harley assist guy ..The police didnt even bother measuring it...Now i cant see how i cut a car off when he skidded in a straight line 32 meters...

    Then I find that the other partys INS co has accepted liability that it was not my fault..But the police say it is my fault...My ins co informed me that the police report was not filled in correctly and is missing lots of information....

    So Police say my fault but insurance co's have determined it was the cars fault...So work that one out hey....

    Anyway I'm alive,although got a long rd ahead recovering but after all that I just cant wait to get back on the road  and ride with my ol mates again...

    PS....Unfortunatly I have to sell what shares i have left (my safety nest egg) to make up the diff but when it comes down to it I'm getting a new bike so just want all to think about thier insurance....When something like this happens we need replacement cover not market value....I have nothiong but praise for QBE as the inspector gave me the highest amount possible payout...Sy's at Liverpool in thier own time at no cost to me pulled off all my bling that could be saved so i can throw it on the new bike.....Which is a nice way to treat thier customer........

    Sounds to me the coppers took the easy way out, blame the "Bikie"

    Now they have left it to you to prove otherwise while they munch on some doughnuts

    Speedy recovery brother. Great to see that necessary evil, "Insurance", has come to the fore...& big bouquet to Sys as well. If driver of vehicle gives hard time, well..."ve haff vays & meens."

    It's good to see you're on the mend. I too have nothing but praise for QBE... They covered me for a broken drive belt.... Getting back to the subject, I know that common sense will prevail. Good luck with it all.

    Phantom, thanx mate i have much more of an understanding how these things work now...And after all its the insurance that is the important bit now...
    Will let ya know how my meet with the Soliciter goes....
    And yes......I have also had a suspician that there may be some relation to the other driver....Im just cranky that I have to make up a 6000 diff for the new bike and now being on disability I thank G-d I had the funds to do that which i would like to get back from the other party...
    All the info and help is very appreciated....

    Letter to Ombudsmen will be written....I just want to be treated fairly and comments like that were more than innapropriate....
    I'm not a bikie but i sure know how it feels to be treated like one.......

    Amazingly relaxed and rational report from Hoody considering the circumstances and injuries. They make 'em tough in HD Land. Mate if I had just had your experience I would be crying like a baby.

    Very sound advice too, from Phantom in particular. Demonstrates yet again the value of the Forum community.

    Great to have you back Hoody, and congrats on the MK11 version of the Blingmobile.

    Tell the good Mrs Hoody that I still have her orchid, can't find anyone that will accept it as a mail article. Will have to wait untill we ride/drive to Sydney next.

    Hope you recover quickly mate and get back on the bike. Sounds to me like the coppers will be well and truely fucked over once it goes to court but they are such arseholes to even let it have to go that far.
