My understanding of these laws is that they could be abused by those in power, to manipulate those without the necessary funds to protect themselves. Even then, there are no guarantees that legal representation will give you the best chance of a far go!

If ordinary bike riders fall prey to these laws you may well be f@#ked!

Do u really think we have any chance of changing this?? Its the beginning of a lot more...We r just bike riders our voice is tiny...I hate that but its a fact we r a minority....Nothing will get better and like a disease it wil spread to the other states... Its like petrol prices..they wont get better but we always hope they do.

.wasn't watching every thread.. just noticed this one whilst lurking.

Yes, I'd like to get the MRA publicly involved, but as you are aware, it's not just up to me. Make no mistake we are doing a lot behind the scenes and would like to think we were at least a little bit responsible for some of the amendments that were made, along with the Greens Mark Parnel and the Democrats Sandra Kanck and everyone who spoke/emailed/wrote to the local pollies on an individual basis.

The MRA is already onboard and have been lobbying this since day one (before anybody had even heard of the Bill last year.) The politicians on BOTH sides have been dodging and changing course as things progressed, much to our disgust. We are also currently looking at political demographics to determine what seats we can influence (marginal ones) at the next election, but right now that isn't really important, it's a longer term goal but one that should inflict "punishment" on the gutless pollies who won't speak up when they KNOW this is bad law.

And Skull - YES!! This is something I have been trying to tell people about (not here - this lot got it up front) and the purpose of my media statements. This actual law does not mention the words "bikie", "motorcycle" in it for example and CAN be targeted at ANYONE the government chooses - I think very dangerous to have that much power in the hands of [relatively] so few people.

Even though I have at times painted an "unreal" scenario, it is not that they WILL happen but that they CAN happen under this law. Not only that, the real danger is that once a control order is put in place or a club is declared banned or whatever, IT CAN'T BE APPEALED. In other words there is no judicial review. This effectively puts executive power in the hands of the parliament and gives the executive (police) tools to sidestep the judiciary. It is these things (the separation of powers of government into: Legislature, Executive and Judiciary) that is the basis of an Australian Constitutional challenge.

The Australian Constitution clearly separates these three areas of "good governance" and this Law attempts to circumvent this independence and in particular the Judiciary. It is for this reason I believe that the Judiciary will oppose this law and can not support it.

But yes, the MRA will continue to fight this in any way we can. So will I. Realistically and from a legal perspective [personally] I do not believe any magistrate will hold-up this law when it comes to the actual court case of anyone who is charged under it. There are simply too many things wrong with it. This does not mean we can sit back and just wait for that - I could be wwwwrong! - and must continue our dissent of this ridiculous law in every way possible, even if to protect other states from going through this same crap.
