Just thought that I would give everyone the low down on what has been happening since my accident.
Went and had a discussion with a solicitor on Wednesday about claiming on CTP.
Well i came away shocked and disappoiinted.
With your CTP if you are involved in a single vehicle, no blame accident (like I was) there is NO claim that can be made.
With CTP you can only claim if there is someone to claim against. Even the RTA and Local council, no claim again cause
no one to claim against. Because there was oil on the raod (as stated in police report) for me to make a claim of any kind
I have to find out who dropped the oil and then claim damages against them. Which is impossible to do.
Even my medical expenses are not covered. In the end it works this way, if you are doing the rite thing and crash on your
own, you are not covered for your injuries, if you crash into another vehicle or another causes your crash you can then
make a claim against them.
So be careful out there and maybe look at taking out extra insurance to cover yourself in all situations, cause if you
think you are covered completely for all circumstances, beleive me you are not.

That's not good news for you NSW riders, considering all the roo's you could hit. I'm glad not all the states are like this, some have a nominal defendant clause in case you hit oil, or a pot hole , or a roo or cow etc etc. Hope the healing goes well mate.

Not a subject everyone likes to discuss, but something that all you guys should have a good look at
Your Superannuation policies should have some attached insurances. Some policies include "Death and Total & Permanent Disablement (TPD) Cover" and some will also include "Income Protection" cover.
Most people overlook all of this as "an unnecessary expense", but unfortunately you also have to look at the people around you and the affect that any unfortunate incident may have on them. Even more so if you are self employed. With the superannuation policies, these insurances are built into many good policies, and will look after you when you need it. The premiums are taken out of the superannuation so are not hitting your hip pocket, and are also usually very small ($3-5 per week) due to the way it is managed. You can also put a little back in as employee contribution, which is matched by the government, and therefore, in effect costs nothing.
So, have a look at this and address this as a real issue, even if you dont like to consider it, and the Superannuation approach can be the best and the cheapest for you. AustralianSuper (for example) has just changed their policies to include Income Protection, and law changes mean you can have your superannuation put anywhere you like it to go, your employer cannot dictate this. So, this is just one of many that will sort out this for you, without much effort, and at very low cost. But have a look at your current superannuation policies, and see what is available, but definitely put some thought into it. It can be set and forget, but you need to set it first.

You should re consult with your solicitor and ask about the 'nominal third party' provisions under the 3rd party legislation. Back in 2000 my mother had a head on collision when she crossed to the wrong side of the road on a corner caused by spilled diesel in northern NSW. This was noted by police.
It was not possible to identify the vehicle that dropped the diesel. Her solicitor was able to use the nominal third party provisions with the police report. It took well over 12 months to get it settled but all medical was paid plus $$ for the permanent injuries received as a result of the accident
I am aware that there were changes in 2006-07 and this may have changed these provisions. This is taken from the Motor Accidents Authority site could be worth a call. I looked into this type of insurance some time ago, because of where i work there was only one company that would insure me and was gunna cost me $400 a month, ffs i'm a low income earner so that quote was horrific.......a few months later another company rang me and said they had changed their policies and could now insure me for a much cheaper premium but was still rather expensive, straight out accident insurance for accidents that dont happen at work seems nearly impossible to find but would be cheaper, it seems most insurers if not all only like to hand out income protection which covers just about anything but is more expensive, most of us are covered by work cover for work related accidents. Is there anyone out there who has a reasonable accident cover without all the bells and whistles of a income protection insurance??

A friend of mine dropped his bike on a roundabout due to spilled oil here in Canberra.
He rang the cops to report the oil so it could get cleaned up but got booked for 'driving without due care' instead!
Income protection insurance is the most important item of insurance cover imho. Costs me around $700 per year - If I'm off work for any reason for more than 30 days - $5K per month is mine to keep the family afloat.

Hmmm - how longs a piece a string? Theres a range of insurers that do Personal Accident and its best just to shop around for your personal circumstances. Be aware of the difference between Personal Accident issued by a General Insurer and Income Protection or Disability Cover issued by a Life Insurance company. They are two very different beasts. The General Insurance product is a cheaper more limited form of cover. Premiums are dictated by how much you want to insure as a weekly benefit (generally capped at 75 -80% of your earnings depending on insurer), your age, your occupation and your waiting period selected (how long you can afford to be off before claiming a benefit - generally a couple of weeks but the longer the waiting period the cheaper the premium). The policy is generally capped at 104 weeks (two years) of benefits. It is underwritten to the same extent a disability policy is because this product is cancellable by the insurers (on renewal if they choose not to offer renewal or material circumstances change they can cancel). There is also usually no need for medicals.
The Life insurance product is much broader. It is not cancellable by the insurers once its set up and generally provides benefits payable to 60 -65. It is underwritten on a much more detailed methodology (medicals etc) and is generally a lot more expensive. It is also subject to all the same factors when determining premiums (age, occupation, waiting period etc etc).
Most of the major insurers offer a product. Have the basics ready and spend an arvo calling them.

Tell the insurance company a big red four wheel drive ran you off the road after you report it to the cops that is lol and tell them it happened so fast you never had time to get the rego
