Went for my defect inspection today and got it removed. Cop this they didn't even do a loudness test.
Anyway I thought I'd make note that he mentioned a lot of bikes getting done for no rear red reflector, ie around the number plate. He marked it down on the system for me but still passed me.
Those going for inspections might just want to chuck a sticky reflecter on for the test.

Just re-fitted the reflector for my inspection this afternoon. I wonder why you need a reflector when your rear tail light is hard wired and on all the time. Thanks for the tip mate.

Just got back from Regency, and they gave the Fatty the going over. Noise test as well And guess what, it failed at 94.5 decibles with the stock mufflers on. W.T.F's going on. All is good though as they are allowed to give a 1 decible allowance,which means it just made it in with a 1/2 db margin. Must of got the same lad as you KC as he mentioned he had checked a Sporty in the morning.
Thank fuck thats over with, now to fight the fine.
The inspection blokes gave me a full copy of the testing requirements for noise testing of motorcycles. After reading through the requirements, it looks as if we have a few grounds for having the fines withdrawn.
1. The microphone must be secured in a holding jig. (Not hand held as in our case)
2. There must bo no objects or people, other than the testers & rider within 3 metres of the bike being tested.(Not 6-12" as in our case)
3. Harley Davidson motorcycles must be reved to 2,500 RPM to obtain a db reading(most of the bikes tested had no tacho's, and the testers had no means of determining engine speed)
I have written to the Manager Expiation Branch asking for the fine to be withdrawn, and if that doesn't work, my lawyer is prepaired to go to court (free of charge) as he is sick of these bastards.

one of the BACA blokes went this morning, the blue dyna with the supertrap on , , they checkt his braking blinkers etc and took defect of , no noise check, its now back to normal
Copy of the letter I have sent, there are a few more testing proceedures that were not done correctly like calibrating the microphone after each test. I will save them for the court date if it goes that far.

Dear Sir / Madam,
I am writing to you to request the above Expiation Notice be withdrawn due to concerns of the legality of the testing regime that led to the notice being issued.
Situation Paragraphs 2.3 and 4.2.3.3 motorcycle (ii)
The rotational speed of the engine shall be measured by either an external tachometer or the vehicles tachometer.
The motorcycle (Harley Davidson) is required to be run to an engine speed of 2,500 RPM to obtain a decibel reading.
Concern
My Harley Davidson, model (FLSTF), does not have a tachometer fitted, and the testing officer did not have any device to measure engine revolutions. How could the test be conducted accurately if there was no means to measure engine revolutions?
Situation 2 Paragraph 3.3
Test site ambient requirements; require that no other person or objects, other than those required to conduct the test and the rider, to be within 3 metres of the microphone in use.
As the photo (attached) clearly shows, 6 motorcycles parked within 6 – 12” of each other, as well there was a police van parked within 1 metre of the last motorcycle in the queue, 11 motorcycles in total, whilst the noise tests were being conducted.
There was also a constant stream of traffic, both cars and semi trailers, driving along Angle Vale Rd and within 1 metre of my motorcycle as the test was being conducted.
Situation 3 Paragraph 4.1.1
The microphone shall be supported by a tripod or similar device not providing excessive acoustic reflection.
No such microphone support was used during the testing, and the microphone was being hand held in different locations to obtain a reading.
Conclusion,
I believe the Expiation Notice #D7611605 A should be withdrawn due to the above concerns, and to save further expense of the matter going to court.
The motorcycle has been to the Vehicle Inspection Station, and been cleared of the defect notice, and I believe that if the testing had been conducted correctly in the first place I would not have been issued the defect notice and the expiation notice.

My Fatty is only 8 weeks old, and it went 1/2 db over the 94db maximum with the stock mufflers fitted. If it wasn't for the 1db allowance they can give, my brand new bike would be illegal with the stock exhaust system fitted. Bit of a worry that one.
