SA Full Court declares Rann's bikie control orders illegal

    THE Rann Government's controversial control orders on outlaw bikie gangs have been declared invalid by the Full Court of the Supreme Court.

    In a landmark 2-1 majority judgment this morning, the Full Court ruled Section 14 of the Rann Government's Serious and Organised Crime Act was not a valid law.

    The court ordererd that a control order placed on Finks Motorcycle Club member Donald Hudson in May was therefore "void and of no effect".

    Justices David Bleby and Trish Kelly ruled the section of the law which prevented named bikies from associating with each other was invalid, while Justice Richard White found the law was valid.

    The judgment is a major setback for the Rann Government's efforts to clamp down on outlaw motorcycle gangs.

    Mr Hudson's lawyer, Craig Caldicott, said the Full Court judgment was a victory for the "little guy".

    "I think it's a great judgment for my clients, we have been vindicated. We have said from day one that section 14 of the Serious and Organised Crime Act is invalid, it's draconian and it's basically un-Australian," Mr Caldicott said.

    "(The decision) helps the little guy. This is all about freedom of association, this is all about people choosing to mix or associate with anyone they like."

    Justice Bleby said he handed down today's ruling "in the firm expectation that this case is not stopping here".

    Mr Caldicott said he also expected the State Government would not accept the ruling.

    "They will probably try to rush through legislation to fix it or appeal to the High Court because they certainly won't like this decision, and this government is very quick to act on things it doesn't like," he said.

    I see this as a victory for all Australians and our freedom that our fathers fought for...Its not about bikies,its about all of us .3 cheers for freedom of association whith whoever we wish to talk to !!

    not surprised .. the real test will be the high court appeal ... in the meantime it may put the brakes on other states .

    As we've maintained all along this egomaniac and his mate the Teflon Tyrant (Atkinson) have been acting illegally to cause public outcry in an attempt to control the entire voting public... Fucking wankers... he he... I'm busier than a one armed piccollo player at the moment and couldn't be happier... Watch out for the midnight legislations being pushed through in the next week... ...

    What pisses me of is the fact that we are the ones paying for the courts and legal people to fight against us !! Can you imagine the legal cost of all this in the supreme court !!!.And its easy when you have a bottomless pit of money that is supplied by us for something that is a total friggin waste of time.Even if they win surely they dont think for a minute that it could be policed and anything will change !!!!IDIOTS...with our money !!!!!!!!!!!!

    a good result today
    lets have a drink to the decision today, tomorrow it will be back in parliament, reworded and re-released, then back to court, this will go on for years until OUR (the public) side cant afford it any more

    I am loving what I read here, this is great news and a true win for all Australians, the average person who wants to have the right and freedom to associate with his mates!!

    I just wish to thank so much all  those who have fought so hard against these bad laws and those who have been vocal in speaking out.  Thankyou Bucket for that excellent utube link, I watched it twice and I am proud to be Australian and so ever greatful to the many people who worked so hard to build Australia to the great place that it is and to all our armed forces personell who served or died  to protect our freedom that allows us to live the great Aussie dream!!!

    Hopefully the South Australian Opposition wont be so quick in voting in any changes to the draconian laws (including the now illegal sect 14-1)

    With an election on soon, the opposition must show some balls in supporting the growing voice of the SA populace in defiance of Rann's vendetta against OMC's.

    Dickhead Atkinson was on Stateline last night, still rekons they are gonna win the war. Deciding if they should spend our taxes and appeal or rewrite the legislation.

    Wishfull thinking Magilla...............although talkin to older riders they tell me that it has always been this way and probably always will be...........Growin up in the sensational 70's i remember my family members (Finks) always goin on about the harrasment...........i guess some things just don't change...........
