Mr Scipione said a team of staff was working fulltime on preparing an application to present to the NSW Supreme Court, asking it to declare a particular bikie gang illegal. "We haven't yet approached the Supreme Court, we are preparing for that," Mr Scipione said. "I would expect that that would be happening in the not too distant future." Mr Scipione said it would not be appropriate to identify the bikie gang in question. Under tough new laws passed in April, the Commissioner can ask the court to declare a motorcycle gang illegal and subject to control orders. Gang members would then be unable to contact each other and would be restricted from involvement in many professions, including the security industry. The laws were rushed through parliament in the wake of a fatal brawl at Sydney airport involving rival bikie gangs, the Comancheros and Hells Angels.
"There's a lot of work to be done here. What you've got to do is understand, you must realise that we really need to get this right," Mr Scipione said. "This will arguably be put under more scrutiny than anything we have done by way of an application for some enforcement permission for generations, I would think. "So what we need to make sure is that we get this right, not get this done quickly. And I've said we will get this right because we would expect that we'll be challenged and challenged to the highest court in the land."
