POLICE have again sought control orders against alleged Finks members, despite a court ruling that stalled operation of controversial anti-bikie laws.
Lawyers for the police today asked the Adelaide Magistrates Court to issue control orders against Brett Kooyman and Robert White, whom they allege to be Finks.
Craig Caldicott, for the men, asked the application be adjourned until July 31, in line with a ruling made on Tuesday by Magistrate Koula Kossiavelos.
Ms Kossiavelos said it would be "impertinent and improper" to control the Finks' movements before the club's Supreme Court appeal against the Serious and Organised Crime (Control) Act 2008 is heard.
Two club members – Donald "Duck" Hudson and Sandro Peter Totani – have challenged the constitutionality of the law, which is the legal mechanism for the imposition of control orders.
Today, Magistrate Gary Gumpl asked why the orders were being sought in the wake of Ms Kossiavelos' decision.
Police lawyers said they clients would be "at a disadvantage" if the application was adjourned, as their evidence against the men would "go stale".
The argument – which failed to sway Ms Kossiavelos on Tuesday – met with no success.
Mr Gumpl ordered the matters be adjourned to July 31.
